    Clearly cares a lot about your privacy. We therefore only process data that we need to (improve) our services and treat the information we have collected about you and your use of our services with care. We never make your data available to third parties for commercial purposes.

    This privacy policy applies to the use of the website and the services provided by clearly.eu. The effective date for the validity of these terms is November 1, 2022 - with the publication of a new version, the validity of all previous versions expires. This privacy policy describes what information about you is collected by us, what this information is used for and with whom and under what conditions this information may be shared with third parties. We also explain how we store your data, how we protect your data from misuse and what rights you have with respect to the personal data you provide to us.     About data processing

    Below you can read how we process your data, where we store it, which security techniques we use and to whom the data can be accessed.

    Web store software

    Shopify Our online store is developed with software from Shopify. Personal data that you make available to us for our services will be shared with this party. Shopify has access to your data to provide us with (technical) support - they will never use your data for any other purpose. Based on the agreement we have with them, Shopify is obliged to take appropriate security measures. These security measures include the use of SSL encryption and a strong password policy. Shopify uses cookies to collect technical information regarding your use of the software - no personal data is collected and/or stored. Shopify reserves the right to share collected data within its own corporate group in order to further improve its services. 

    E-mail and mailing lists

    Klaviyo Our website uses Klaviyo, a third-party provider that handles email traffic coming from our website and sending any newsletters. Virtually all confirmation emails you receive from our website and web forms are sent through Klaviyo's servers - other emails go through Shopify's servers. Klaviyo will never use your name and email address for its own purposes. At the bottom of every e-mail sent automatically through our website you will see the "Unsubscribe" link. If you click this, you will no longer receive emails from us. However, this may reduce the functionality of our website. Your personal data is stored securely by Klaviyo. Klaviyo uses cookies and other Internet technologies that provide insight into whether emails are opened and read. Klaviyo reserves the right to use your data to further improve the service and to share information with third parties.

    Payment processors 

    Stripe (Shopify Payments) For handling (part of) the payments in our online store we use the platform of Stripe. Stripe processes your name, address and place of residence and your payment information such as your bank account or credit card number. Stripe has appropriate technical and organizational measures to protect your personal data. Stripe reserves the right to use your data to further improve the service and to share (anonymized) data with third parties. All the above guarantees regarding the protection of your personal data also apply to those parts of Stripe's service for which they use third parties. Stripe does not retain your data longer than permitted under the statutory time limits.

    Mollie For handling (part of) the payments in our online store we use the platform of Mollie. Mollie processes your name, address and place of residence and your payment information such as your bank account or credit card number. Mollie has taken appropriate technical and organizational measures to protect your personal data. Mollie reserves the right to use your data to further improve its services and to share (anonymized) data with third parties. All the above guarantees regarding the protection of your personal data also apply to those parts of Mollie's services for which it engages third parties. Mollie will not retain your data longer than permitted under the legal terms.

    PayPal For handling (part of) the payments in our store we use the platform of PayPal. PayPal processes your name, address and place of residence and your payment information such as your bank account or credit card number. PayPal has taken appropriate technical and organizational measures to protect your personal data. PayPal reserves the right to use your data to further improve its services and to share (anonymous) data with third parties as part of this process. All of the above guarantees regarding the protection of your personal data also apply to those parts of PayPal's service for which they use third parties. PayPal will not keep your data longer than permitted by the legal time limits.

    Klarna For handling (part of) the payments in our online store we use the platform of Klarna. Klarna processes your name, address and residence details and your payment information such as your bank account or credit card number. Klarna has appropriate technical and organizational measures to protect your personal data. Klarna reserves the right to use your data to further improve the service and as part of this (anonymized) data to share with third parties. All the above guarantees regarding the protection of your personal data also apply to the parts of Klarna's services for which they use third parties. Klarna will not retain your data longer than permitted under the statutory periods. 

    Shipping and logistics

    PostNL and DHL When you place an order with us, our job is to get your package delivered to you. We use the services of PostNL and DHL to carry out deliveries. It is therefore necessary that we share your name, address and place of residence data with these three parties. They use this data only for the purpose of executing the agreement. If PostNL or DHL engage subcontractors, they will also make your data available to these parties.

    Invoicing and accounting

    ENTRPNR and Yuki For our record keeping and accounting, we use the services of ENTRPNR and Yuki. We share your name, address and place of residence information and details regarding your order. This data is used for the administration of sales invoices. Your personal data is transmitted and stored securely - ENTRPNR and Yuki have taken appropriate technical and organizational measures to protect your data from loss and unauthorized use. ENTRPNR and Yuki are obliged to maintain confidentiality and will treat your data confidentially. ENTRPNR and Yuki will not use your personal data for purposes other than those described above.

    Purpose of data processing

    General purpose of processing
    We use your data exclusively for the purpose of our services. This means that the purpose of the processing is always directly related to the order you provide. We do not use your data for (targeted) marketing. If you share information with us and we use this information - other than at your request - to contact you at a later time, we will ask your explicit permission. Your data will not be shared with third parties other than to fulfill accounting and other administrative obligations. These third parties are all bound to confidentiality by virtue of the agreement between them and us or an oath or legal obligation.

    Data collected automatically
    Data automatically collected by our website is processed for the purpose of further improving our services. This data (e.g. your IP address, web browser and operating system) is not personal data.

    Cooperation with fiscal and criminal investigations
    In appropriate cases, Clearly may be required by law to share your data in connection with governmental fiscal or criminal investigations. In such a case we are forced to share your data, but we will resist within the possibilities offered by law.

    Retention periods
    We keep your data for as long as you are our customer. This means that we will keep your customer profile until you indicate that you no longer wish to use our services. If you indicate this to us, we will also interpret this as a forgetting request. Due to applicable administrative obligations, we must retain invoices containing your (personal) data - we will therefore retain this data for as long as the applicable term runs. However, employees no longer have access to your client profile and documents that we have produced in response to your instructions.

    Your Rights
    Pursuant to the applicable Dutch and European legislation, as a data subject you have certain rights with respect to personal data processed by us or on our behalf. We explain below which rights these are and how you can invoke these rights. In principle, to prevent misuse we only send copies and copies of your data to your e-mail address already known to us. If you wish to receive the data at a different e-mail address or, for example, by post, we will ask you to identify yourself. We keep records of processed requests - in the case of forgetting requests we administer anonymized data.     You always have the right to have the data we process (or have processed) that relates to your person or can be traced back to you rectified. You can submit a request to this effect to our team and will receive a response to this request within 5 working days. If your request is granted, we will send you, at the e-mail address known to us, a confirmation that the data has been changed.

    Right to restriction of processing
    You always have the right to restrict the data we process (or have processed) that relates to your person or can be traced back to you. You can make a request to this effect to our team. You will receive a response to your request within 5 working days. If your request is granted, we will send you a confirmation at the e-mail address known to us that the data will no longer be processed until you revoke the restriction.

    Right of portability
    You always have the right to have the data we process (or have processed) that relates to your person or can be traced back to you, carried out by another party. You can make a request to this effect to our team. You will receive a response to your request within 5 working days. If your request is granted, we will send you, at the email address known to us, copies or transcripts of all data about you that we have processed or that has been processed on our behalf by other processors or third parties. In such a case, we will in all likelihood no longer be able to continue to provide our services, because the secure interconnection of data files can then no longer be guaranteed.

    Right of objection and other rights
    You have the right to object, in appropriate cases, to the processing of your personal data by or on behalf of Clearly. If you object, we will immediately cease data processing pending the resolution of your objection. If your objection is well-founded, we will make copies and/or copies of data that we process (or have processed) available to you and then cease processing permanently.

    Cookies
